AN ECHUCA truck driver who grew a cannabis plant in his back yard has been convicted and fined $200.

Justin David Wells, 45, pleaded guilty in Echuca Magistrates Court on Tuesday to cannabis cultivation.

Police prosecutor Senior Constable Dave Rennie said police searched Wells’ home on March 23 this year, the day after he was involved in a truck rollover.

Police found a cannabis plant in poor condition growing in his backyard, which Wells said was for his personal use.

The court heard he had been convicted and fined $700 in 2010 for the same offence.

Duty solicitor Glenn Cooper said the plant was small and not sophisticated.

‘‘It wasn’t usable,’’ he said.

‘‘He has been a long-term user of cannabis.’’

Mr Cooper agreed if Wells had have tested positive to cannabis after the truck rollover, he would be facing a different jurisdiction.
