A MAN who lit a fire in his Kyabram backyard during a total fire ban has been handed a $750 fine.
And the court heard he knew of the ban but thought he could get away with it at night time.
Michael William Smith, 33, appeared in Echuca Magistrates Court to plead guilty to the offence.
Police prosecutor acting Sergeant Sally Mannell told the court Smith set fire to rubbish and an old mattress on January 17.
‘‘At around 6pm the accused lit the fire in his backyard in McEwen Rd, Kyabram,’’ she said.
‘‘A witness reported seeing and smelling smoke coming from the yard and police arrived at 11pm.’’
The next day Smith was interviewed.
‘‘When asked if he knew it was a day of total fire ban he said he did but thought it would be ok lighting it at night,’’ acting Sergeant Mannell said.
Magistrate Dr Michael King said a fire at that time of year is risky.
He was fined without conviction.
